Terms of Service

1. Overview

These Terms of Service ("Terms") govern your use of the MotionCaption website, account dashboard, After Effects and Premiere extensions, downloadable software, caption presets, AI features, and any related products or services that reference these Terms (together, the "Services").

By installing MotionCaption, creating an account, starting a trial, or using any part of the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. What MotionCaption Is

MotionCaption is a tool for creating animated captions and short form social video inside Adobe After Effects and Premiere. It combines a large preset library (330+ animated caption styles in After Effects and a smaller preset library in Premiere), a media library, and AI features such as transcription, translation, highlight suggestions and other creative tools. Presets can be applied in one click or customized and batch applied to change animations, transitions, filters, effects, emojis, icons and other repetitive caption styling tasks.

In After Effects, MotionCaption outputs native text layers in your composition so you can adjust fonts, colors, animation and other properties directly in your project. In Premiere, MotionCaption uses a MoGRT based workflow with more limited controls than native After Effects compositions but still more flexibility than typical caption templates.

Adobe, After Effects and Premiere are trademarks of Adobe. MotionCaption is developed independently for use with compatible Adobe products. Adobe is not responsible for the Services and is not a party to these Terms.

3. Eligibility and Accounts

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with permission and supervision from a parent or legal guardian.

You are responsible for any account you create, including keeping your login details confidential and for all activity under your account. Accounts are licensed on a per person basis and must not be shared by multiple individuals at the same time unless we expressly allow this in a separate agreement.

4. Scope of These Terms

These Terms apply to your use of all self serve MotionCaption offerings, including the marketing site, user dashboard, free trials, one time purchase licenses, subscription plans, AI powered features, and the After Effects and Premiere extensions and installers.

If you have a separate written agreement with us that is signed by both parties, that agreement will control to the extent it clearly conflicts with these Terms.

5. License and Permitted Use

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non exclusive, non transferable, non sublicensable, revocable license to install and use the MotionCaption extension and related software for your own personal or internal business use.

This license does not transfer ownership of the Services or any part of them. All rights not expressly granted are reserved.

You must not copy, modify, distribute, sell, lease, or commercially exploit the Services except as allowed in these Terms. You must not reverse engineer, decompile, disassemble, or attempt to access source code or underlying models where this is restricted by law. You must not use MotionCaption to build a directly competing product or to benchmark it for external publication without our written consent.

6. Host Software and System Requirements

MotionCaption requires compatible host software and a compatible device. You are responsible for obtaining and maintaining a valid license for any required host software, including Adobe After Effects or Premiere, as well as a supported operating system and internet connection.

We do not guarantee support for every version of After Effects or Premiere or for every operating system configuration. We may add or remove supported versions over time as Adobe or platform requirements change.

7. Plans, Billing and Renewals

MotionCaption may offer free trials, one time purchase licenses, monthly or annual subscriptions, and other plans. Current pricing, included features, AI credit limits, and billing periods are shown at checkout or in your account dashboard.

By starting a paid plan, you authorize us and our payment processor to charge your selected payment method for all applicable fees, taxes and renewals. Unless stated otherwise, subscriptions renew automatically at the end of each billing period until you cancel. You can cancel future renewals through your account or by contacting support, but cancellation normally takes effect at the end of your current paid term.

Fees are generally non refundable except where we are required by law to offer a refund or where we state a specific refund policy in writing, such as a time limited money back guarantee on first purchase. If we issue a refund or credit, this is at our discretion and does not create an ongoing obligation to do so again.

8. AI Credits and Usage Limits

Some features of MotionCaption, such as cloud transcription, translation, or AI creative tools, may use credits, minutes, or similar usage based limits. Plan specific limits and how usage is measured are described in the product or checkout flow.

Unless we clearly state otherwise, unused credits included with a subscription do not roll over between billing periods. Credits you purchase separately (credit packs and one-time starter credits) remain available until used. We may temporarily limit or disable AI powered features when you reach your plan limits or if there are technical or abuse related concerns. We may adjust how usage is measured or allocated in future releases as long as this complies with applicable law and any separate written agreement with you.

9. Your Content and Outputs

You retain ownership of the content you upload, import, or process with MotionCaption, including your audio, video, caption files, transcripts, and project materials ("Customer Content"). Subject to the rights of any third party whose materials you use, you also retain ownership of the caption layers, SRT files, text exports and other outputs you create with MotionCaption ("Outputs").

You grant us a limited, non exclusive license to host, process and use Customer Content and Outputs only as needed to provide and improve the Services, troubleshoot issues, enforce these Terms, and comply with law. We do not claim ownership of your underlying footage or finished edits.

You are responsible for ensuring that you have all rights, consents and permissions needed for Customer Content and Outputs and for how you use, share or publish them. You must not upload or process content that is unlawful or that you do not have the right to use.

10. Acceptable Use

You agree to use MotionCaption only for lawful purposes and in line with these Terms. You must not use the Services to infringe intellectual property rights, violate privacy, harass or harm others, share malware, probe or attack our systems, bypass usage or billing limits, or run projects that require regulatory controls we do not clearly support, such as processing highly regulated health or payment data through our cloud services.

We may investigate suspected misuse and may suspend or terminate access where we reasonably believe that your use is abusive, fraudulent, unsafe, or clearly in violation of these Terms or applicable law.

11. Software, Installation and Updates

MotionCaption may include installers, updates and other client side components. You agree to install the extension only from trusted sources we provide and to keep your installation reasonably up to date so that you receive security fixes and compatibility updates.

We may release updates that change how features work, add or remove functionality, or are required for security or compatibility with recent Adobe releases. Certain features may require a current version of the extension or dashboard to continue working as expected.

12. Third Party Services and Links

The Services may depend on or integrate with third party providers, such as payment processors, hosting providers, analytics tools, transcription or AI providers, and the Adobe ecosystem. We do not control third party services or their terms, and your use of them is subject to their own policies.

Any links to third party sites or services are provided for convenience and do not mean we endorse or are responsible for those sites. You are responsible for checking third party license terms, including for fonts, stock media, emoji sets or other assets you decide to use in your projects.

13. Intellectual Property

MotionCaption, including the software, presets, documentation, website, design, branding and other related materials, is protected by copyright and other intellectual property laws. Except for the limited license granted in these Terms, you receive no rights to our trademarks, logos, brand elements, default preset designs or the underlying code or models used to run the Services.

If you choose to send us ideas, feedback or suggestions, you agree that we may use that feedback for any lawful purpose without obligation to you.

14. Service Availability and Changes

We aim to keep MotionCaption available and useful, but we do not guarantee that the Services will be available at all times or that every feature will remain unchanged. We may change, suspend or discontinue parts of the Services, including specific integrations or AI features, for technical, legal or business reasons.

We are not responsible for outages or issues caused by factors outside our reasonable control, such as network problems, hosting provider incidents, or changes introduced by Adobe or other third parties that affect extension behavior.

15. Disclaimers

You use MotionCaption at your own risk. The Services are provided on an "as is" and "as available" basis. To the extent allowed by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non infringement.

We do not promise that the Services will be uninterrupted or error free, that AI features or transcription will always be accurate or suitable for your specific project, or that every integration or preset will suit your creative, legal or compliance needs. You are responsible for reviewing captions and outputs before publishing or relying on them.

16. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or business opportunities, arising from or related to your use of the Services, even if we have been advised of the possibility of such damages.

To the extent allowed by law, our total liability for any claims relating to the Services or these Terms is limited to the greater of the amount you paid for MotionCaption in the twelve months before the event giving rise to the claim or one hundred United States dollars (USD 100).

17. Indemnification

You agree to indemnify and hold harmless MotionCaption and its owners, employees and contractors from and against reasonable claims, losses, damages and expenses, including legal fees, arising from your Customer Content or Outputs, your use of the Services, or your clear breach of these Terms or applicable law.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page and may provide additional notice through the site, the extension, or by email. Your continued use of the Services after updated Terms take effect means you accept the changes. If you do not agree to the updated Terms, you must stop using the Services and uninstall the extension.
